These terms and conditions shall govern all contracts entered into by Lifestyle Appliances Limited.

GENERAL

The Seller only does business upon the terms of these Conditions of Sale which shall be deemed to be interpreted in any contract between the Buyer and Seller.  These Conditions of Sale shall not be altered Or varied except by specific written amendment signed on behalf of the Seller and shall take effect to the exclusion of any terms or conditions stipulated by the Buyer.

QUOTATIONS

The Seller reserves the right to cancel or withdraw any quotations without notice at any time before acceptance.  A quotation issued by the Seller does not constitute an offer to supply goods and any order placed by the Buyer following a quotation issued by the Seller shall not be binding on the Seller unless and until accepted by the Seller in writing.

PRICE

The price of goods is ex–works and excludes delivery or transport charges and insurance in transit and excludes V.A.T or any other tax duty.  Prices quoted apply only if full quantity is ordered. Order Acknowledgments are sent via e-mail to confirm products ordered & prices, it is the buyers responsibility to check acknowledgements and advise directly if the item or price is incorrect. If no notification is confirmed at this stage the prices will be invoiced as per order acknowledgment.

DELIVERY INFORMATION

Any time or date for delivery named by the company or its representatives is an estimate only.  The company shall not be liable for the consequences of any delay, and delay will not entitle the Buyer to claim damages and/or repudiate the agreement.

PAYMENT TERMS

Payment terms are strictly net 30 days from the end of the month. Earlier settlement i.e. 7 days can be subjected to discount; this must however be negotiated and agreed at the time of ordering.  Cheque or Bacs  payments in Settlement of invoices submitted should be made payable to Lifestyle Appliances Limited, Unit 66 Enfield Industrial Estate, Redditch, Worcestershire B97 6DE. New Customers entering into a contract with Lifestyle Appliances, payment is on a Pro Forma basis until such time that trading history is established between the Seller and the Buyer. Order Acknowledgments are sent followed by a pro forma invoice with all relevant bank details.

RETENTION OF TITLE

The Seller reserves the right of title to the goods under the provisions of sections 19 The Sale of Goods Act 1979 until all monies owing have been paid in full by the Buyer.

CARRIAGE

Orders of £650(Leisure products) & £500 (Industrial Products) net value will be carriage paid to addresses within the UK Mainland, exceptions to this will be made if we are requested to deliver our goods by any other means than our normal carrier services.  For Order values less than £650 (Leisure Products) & £500 (Industrial Products) a standard tariff Will be charged. For all Internet & promotion   Companies, requiring a direct home delivery service to their customer, this will always carry a carriage charge depending on Product, Carrier type and postcode area. This is also relevant for Buyers who require a direct home delivery service regardless of the amount of the order.

CLAIMS

Any claims for wrong or short delivery shall be put into writing by the Buyer to the Seller within 7 days or receipt of goods otherwise the claim will not be accepted.  Goods presented by the Buyer to be defective shall not form the subject of any claim for work done or for any loss or damages or expense whatsoever arising directly or indirectly from such defects.  Such goods if returned to the company at the expense of the Buyer and provided that the complaint has been received by the company within 7 days from the date of delivery and accepted by the company as defective, will at the option of the company be repaired or replaced by goods as nearly similar to that originally ordered.  No defect or damage suffered by the Buyer shall be grounds for cancellation of the remainder of the order or contract.

DAMAGED GOODS

If goods are received and are found to be damaged the Buyer must notify the company on the day of receipt as carriers will not normally accept claims more than 24 hours following delivery.
